I am directed by the Board of Trade to transmit to

you copy of a letter and enclosures from the colonial office

regarding the import into liong Kong of spirit manufactured

in France labelled as scotch Whisky. A specimen label

is enclosed in original, for eventual return to the

Colonial office.

Mr. Secretary Henderson will be aware that France

is a party to the International Convention for the

Frotection of Industrial property of 1911, article lu

of which provides that "every production which may

falsely bear as indication of origin the name of a

specified locality, when such indication shall be joined

to a trade name of a fictitious character, or used with

intent to defraud", shall be seized, in accordance with

the stipulations of article 9 of the Convention. Such

seizure is to be effected equally in the country where

the mark is applied as in that with which the production
